Welcome to our online site. We are pleased for you to browse information about the goods and services that we provide in our store. By using this site you acknowledge the terms below apply.

Pricing

Unless stated otherwise prices stated on this site do not include sales tax and are discounted for settlement by a single payment at the time of purchase. Price may vary with the form of payment. We attempt to keep prices accurate on btsouth.com but from time to time we miss one and it would be a good idea to call ahead to verify price as well as availability.

Privacy and Electronic Communication

When you visit this site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Accuracy of Information

We attempt to be as accurate as possible. However, we do not claim or guarantee that product descriptions, price or other content of this site is accurate, complete, reliable, current, or error-free. If you see a price that looks too good to be true, or too terrible to be true, then it very well may be, not on purpose, but we reserve the right to make mistakes as humans do. If you do find information in error, or question whether it is correct, then please bring it to our attention that we may verify it is correct or get it corrected. If a product offered by us is not as described, your sole remedy is to return it in unused condition.

Disclaimer of Warranties and Limitation of Liability

The service and content from or through this site are provided "as-is," "as available," and all warranties, express or implied are disclaimed. (Including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose.). B T South and affiliates will not be liable for any damages of any kind arising from the use of this site.

Severability

Should any provision of this Agreement be determined to be void, invalid, unenforceable or illegal for whatever reason, such provision(s) shall be null and void; provided, however, that the remaining provisions of this Agreement shall be unaffected thereby and shall continue to be valid.

Service & Repair Terms of Service

Responsibility for Materials & Labor Expended

Customer agrees to be responsible for diagnostic and repair time spent and parts & materials used not covered by the manufacturer. B T South agrees to discuss with the customer the decions points along the way to manage and limit expense.

Storage & Disposal

A $3 per day storage fee will apply after a period of 14 days of waiting on the customer to either approve work or to pickup equipment after B T South's approved work is complete. At day 40 equipment may be disposed of at the discretion of B T South without obligation to the customer.

Loading, Unloading & Tying Down

Customers who provide transport of equipment to and from B T South are responsible for loading, unloading & safely tying down equipment prior to transport. Customer agrees to hold B T South harmless for any assistance provided by B T South staff or associates.

Use of B T South Trailers

Those who use BT South trailers do so agreeing to be responsible for the prompt return of the trailer unharmed and to hold B T South free from liability for any harm related to use of the trailer.

Customer Trailers Stored at B T South

For customer convenience BTS will conditionally allow customers to store a trailer on site at their own risk during the time their equipment is being serviced. In the event a trailer or something on a trailer is stolen or damaged, customer agrees to hold B T South harmless.

Term

Agreement to these terms applies to current and future transactions until replaced or canceled in writing.

Reasonable Conduct Terms of Service

Respect and Reason

Our customers deserve to be treated with respect and a helpful attitude. If we fall short of that then we apologize and would like for it to be brought to our attention.

Likewise our staff deserve at minimum a basic level of respect from customers. Those who can't be respectful may be asked to not be our customer. While servicing thousands of customers each year, on the rare occasion of once or twice a year, we have to part ways with a customer. It's not something we do flippantly or take lightly, but it is crucial to maintaining the right staff. If we don't protect our staff then they will find more desirable employment elsewhere.

Certain behaviors are simply not tolerable:

  • Cursing & abusive behavior
  • Yelling & screaming
  • Threatening behavior
  • Refusing to cooperate
  • Demanding to be treated differently than every other customer is treated under the same circumstances

Since manufacturer warranties are an obligation of the manufacturer to the customer, the termination of any relationship between a customer and a dealer has no impact on manufacturer warranties, except that the customer will have one less dealer to choose from to perform manufacturer approved warranty work.

Return Policy

Returns of Items Purchased in Store

You may return most new, unopened parts for refund within 30 days of purchase. These items should be in their original packaging. See exceptions below.

If you would like to return or exchange a part, contact us at 336-299-5000 or simply bring the part back to the store.

Returns may be subject to a restocking fee.

Returns will not be accepted for items that are:

  • Opened or used
  • Electrical parts
  • Fuel related parts
  • Special order parts
  • Equipment whole goods
  • Knives / Cutlery
  • 30 days after receipt

What happens if my new equipment fails due to a defect in the first week I own it? That's precisely why manufacturers have warranties for their equipment, and the most likely time for a manufacturing defect to reveal itself is in the first hours of use. What happens is the manufactuer pays their service center to replace the failed part or whatever is required to remedy the defect. For most brands the equipment dealers are also service centers for the brand.
